Re Foxton Investments Ltd

We act for Foxton Investments Ltd a property investment company. Our client purchased the freehold of 30 Red House Lane, Oxford in January 2017. The property is subject to an occupational lease in favour of an architect, Mr Richard Sykulu. Mr Sykulu has always paid his rent on time and is not in breach of any lease covenants. The lease expires on 29 September 2021 and our client is keen to secure vacant possession of the property as soon as possible to carry out various improvements and alterations prior to using the premises as its own local office. Mr Sykulu has indicated informally to the client that he does not wish to give up possession.

Please prepare a memorandum of the legal advice we should give our client and the procedure for recovering possession.
