1. Search for information concerning the history and current practices of racial and ethnic minority legal defense and education funds. Determine the degree to which they operate similarly and differently. To what degree do they have the same goals and purposes? Would it be worthwhile for them to join forces?

2. Examine the degree to which current Justices on the Supreme Court claim to follow the idea of original intent versus a living constitution. Compare this to how they have ruled on cases specific to racial and ethnic minorities, civil rights, business, and politics.

3. Search for information concerning the Merrick Garland nomination to the Supreme Court. Why did the Republican senators choose to not engage in “advice and consent” in this instance and to what degree can that decision be considered constitutional?

4. Examine the circumstances of Brett Kavanaugh’s nomination to the Supreme Court, as well as his Senate Judiciary committee hearings. Research the similarities and differences between these hearings and those for Clarence Thomas.
