You should point out that Pt II ERA requires certain qualifications, for example to submit a claim in time.
You should note that, although Alex has not fully performed his part of the bargain, unless his contract states otherwise he is entitled to be paid for the work he has done.
You should emphasise that the employer may have a cross-claim for damages but this does not affect Alex’s right to wages under Pt II ERA.
