Chapter 8 Guidance on answering the exam questions

Critically examine the importance of the rule of law in the UK, providing examples of its application to support your answer.

  • Explain the different meanings of the rule of law and its purpose as a guiding mechanism. Refer to theorists.
  • Consider how rule of law links to separation of powers (see Chapter 7).
  • Spend some time examining the core, middle and wide meanings and how they apply in the UK. Find examples, especially cases, to illustrate the practical application of each one.
  • Assess how your examples show whether rule of law is important in the UK e.g. controlling government power, protecting the rights of individuals. Why is it important to do that?
  • Are there any examples where the UK falls short of adhering to rule of law principles? (You might find it helpful to look at Chapter 2 for past examples of what happens when the rule of law is not observed.)
