‘The separation of powers has no relevance in the UK constitution.’ Discuss.

  • Define what the separation of powers doctrine is and why it exists. Refer to the views of theorists.

  • Explain how partial separation of powers operates in the UK. How is power divided? How well does it work? Use examples to support your arguments
  • Assess how your examples contribute to efficiency, for example, or control of a particular arm of state. Or are there too many overlaps? Think about how checks and balances work and why they are important.
  • Consider how the dividing lines work in practice in the UK. How did the Constitutional Reform Act 2005 make a difference?
