Question 1: Can you request a face-to-face hearing before a District Judge where a telephone hearing has been automatically listed?

The answer is broadly yes – see PD 23.6,

Question 2: Would your answer be any different if the application was before a Master?

Yes, because the rules in relation to telephone hearings do not apply to the Royal Courts of Justice.

Question 3: Who arranges a telephone hearing?

PD 23.6 states that it is the applicant’s legal representative. If it is a CMC then it is usually the Claimant’s solicitor.
