Chapter 12 Guidance on answering the discussion points

Para 12.32

How many reasons can you think of for an increased order book?

Consider how many possible reasons are related to genuine innovation and a need for IP protection, as opposed to reasons that may have little or nothing to do with novelty and might be more about, say, effective marketing.

Para 12.110

The UK IPO has produced guidance on licensing intellectual property, including licences of right, www.gov.uk/guidance/licensing-intellectual-property. This includes a checklist and a skeleton licence. Have a look at this and think about what might be the three most important things to pick up. What factors influence your answer?

Hint: What is the most important priority of the business in question and who are you acting for? Are you looking for a certainty in relation to payments or to take a risk on success? Do you think there will be improvements in the technology? Do you want a short or a long term relationship? How much do you trust the other party and what are your respective strengths and weaknesses? Might this arrangement be part of a wider suite of agreements and collaboration?
